For job seekers and agencies
Terms of Service
One agreement for workers, job seekers, recruitment agencies, and their authorized representatives.
Draft updated August 31, 2026
1. Acceptance, scope, and definitions
These Terms of Service govern LayagOFW websites, accounts, profiles, job listings, applications, messaging, agency tools, verification workflows, billing features, and related services (the “Platform”). By creating an account, accessing a restricted feature, posting a job, applying, or otherwise using the Platform, you agree to these Terms and the Privacy Policy.
“Job seeker” or “worker” means a person using LayagOFW to explore or apply for overseas work. “Agency” includes a Philippine recruitment or manning agency and its authorized representatives. “Principal” or “employer” means the overseas entity for which an agency recruits. “Content” includes profiles, documents, listings, messages, application answers, and other materials submitted to the Platform.
2. The Platform’s role
LayagOFW is not a recruitment agency, manning agency, employer, overseas principal, immigration adviser, or government office. The Platform helps job seekers and agencies discover one another, exchange information, and manage recruitment activity.
A DMW-license reference, directory record, platform verification, badge, or published job does not constitute government endorsement, a guarantee of identity, or a promise of employment, visa issuance, processing, deployment, salary, or contract performance. Agencies and principals make their own recruitment and employment decisions.
3. Eligibility and authority
A worker account is for persons at least 18 years old who may lawfully seek overseas employment. Additional age, qualification, health, immigration, or destination requirements may apply to a particular role.
An agency user represents that they are authorized to act for the agency named in the account. Agencies must maintain all licenses, accreditations, registrations, job-pool approvals, and authority required by Philippine law and the destination country throughout their use of the Platform.
4. Accounts and security
You must provide accurate, current, and complete account information, keep it updated, safeguard credentials and verification codes, and promptly report suspected unauthorized access. You are responsible for activity performed through your account unless applicable law provides otherwise.
Accounts are personal to the registered user. You may not share, sell, transfer, impersonate another person, or create an account for someone without lawful authority and their knowledge.
5. Job seeker and worker responsibilities
Workers must submit truthful qualifications, work history, identity details, documents, availability, preferences, and application answers. You decide whether to apply and which information to provide, subject to information required for a lawful recruitment process.
You must review job details and agency identity carefully, attend required official processes, keep your contact details current, and tell the relevant agency if your circumstances or submitted information materially changes. Applying does not create an employment relationship or guarantee selection or deployment.
6. Agency responsibilities
Agencies must publish only real, current, lawful openings that they are authorized to recruit for and must accurately state the position, destination, qualifications, compensation, benefits, contract conditions, recruitment status, and material limitations. Listings must be updated, paused, or closed when no longer available.
Agencies must follow applicable recruitment, migrant-worker protection, anti-trafficking, labor, consumer, anti-discrimination, records, and privacy laws. Candidate data may be used only for legitimate recruitment and related legal obligations, with appropriate access controls, confidentiality, retention, and deletion practices.
- Do not misrepresent a DMW license, principal, approved job pool, vacancy count, compensation, contract, or deployment timeline.
- Do not request or collect prohibited fees, payments, documents, or sensitive information through unofficial or unlawful channels.
- Respond to applications and status changes honestly and within a reasonable period.
- Ensure team members and service providers with candidate access are authorized and bound by suitable safeguards.
7. Listings, applications, and messages
LayagOFW may structure, classify, format, or moderate listings and profiles to support search, safety, and usability without changing their essential meaning. Search rank, recommendations, featured placement, delivery of notifications, and application visibility may vary and are not guaranteed.
Application and message status indicators describe Platform activity only. They may not reflect every off-platform action, agency decision, government process, or employer communication. Keep important records and verify material instructions through official agency channels.
8. Agency directory and verification information
LayagOFW may display agency information from public government records, agency submissions, or other lawful sources. DMW licensing and Layag verification are distinct. Directory information may be incomplete, delayed, or affected by the date of the source record.
Agencies may be asked to confirm identity, authority, contact details, license information, and supporting records. Verification may be refused, suspended, or withdrawn when information cannot be confirmed. Agencies should report directory errors and provide reliable supporting material for corrections.
9. Illegal recruitment and worker safety
Never rely on a Platform badge alone. Verify an agency and its current authority through official Department of Migrant Workers channels before paying money, surrendering original documents, attending travel arrangements, or accepting an offer. Use only official agency payment and document-handling processes and obtain proper receipts.
Report suspicious listings, impersonation, trafficking indicators, unauthorized recruitment, requests for secret payments, or threats to LayagOFW and the appropriate government authority. LayagOFW is not an emergency service; contact local emergency services or law enforcement when someone is in immediate danger.
10. Prohibited conduct
You may not use the Platform to facilitate unlawful, deceptive, abusive, or unsafe activity.
- Commit fraud, illegal recruitment, human trafficking, identity theft, harassment, exploitation, or unlawful discrimination.
- Post false openings, fabricate applications or credentials, impersonate users, manipulate reviews or metrics, or conceal material recruitment terms.
- Scrape, harvest, resell, disclose, or use personal data outside the permitted recruitment purpose.
- Send spam, malware, unsolicited marketing, or content that infringes privacy, intellectual-property, or other rights.
- Bypass access controls, probe security, overload the service, reverse engineer restricted systems, or interfere with another user’s access.
- Use automated means to create accounts, submit applications, contact workers, or extract Platform content without written permission.
11. Fees, credits, and agency purchases
LayagOFW currently does not charge workers to create a profile, browse jobs, or submit an application through the Platform. This does not address lawful charges, if any, imposed outside LayagOFW under applicable recruitment rules; workers should verify any requested payment with the DMW.
Agency features may require subscriptions, credits, campaign purchases, or other fees shown before purchase. Credits and paid placement do not guarantee applicants, hires, processing, or deployment. Taxes, expiry, refunds, and cancellation rights are governed by the terms shown at checkout, the applicable service agreement, and mandatory law.
12. Content, permissions, and confidentiality
You retain ownership of Content you submit. You grant LayagOFW a non-exclusive, worldwide, royalty-free permission to host, copy, format, transmit, display, and otherwise process that Content only as reasonably needed to operate, secure, improve, and provide the Platform and the recruitment actions you request. This permission ends when the Content is no longer needed, subject to backups, legal retention, disputes, and records of completed activity.
You must have the rights and lawful basis needed to submit Content. Information marked private or provided in an application must be treated as confidential and accessed only by people who need it for the permitted purpose.
13. Privacy and data protection
The Privacy Policy explains the personal information LayagOFW handles, why it is processed, who may receive it, retention criteria, security measures, and available rights. Agencies may become independent personal information controllers for applicant data they receive and are responsible for their own notices, lawful bases, security, retention, and rights handling.
14. Intellectual property
The Platform software, design, trademarks, logos, and original materials belong to LayagOFW or its licensors and are protected by applicable law. These Terms give you a limited, revocable, non-transferable right to use the Platform for its intended purpose; they do not transfer ownership or permit commercial copying, resale, or creation of confusingly similar services.
15. Third-party services and links
The Platform may link to or depend on government sites, payment providers, identity or communication services, maps, analytics, cloud hosting, or other third parties. Their availability, content, and processing are governed by their own terms and privacy notices. LayagOFW is not responsible for third-party services outside its control.
16. Moderation, suspension, and termination
LayagOFW may review, restrict, remove, preserve, or disclose Content and may suspend or terminate access when reasonably necessary to enforce these Terms, protect users, investigate suspected fraud or security incidents, comply with law, or respond to a regulator. Where appropriate, we may request clarification or supporting records before acting.
You may stop using the Platform and request account closure. Closure does not erase payment obligations, lawful records, completed recruitment records, safety evidence, or provisions intended to survive termination.
17. Availability and changes to the service
The Platform may be changed, interrupted, limited, or discontinued for maintenance, security, legal, operational, or product reasons. We will use reasonable efforts to communicate material changes, but uninterrupted or error-free availability is not guaranteed.
18. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Platform is provided on an “as is” and “as available” basis without implied guarantees beyond those that cannot lawfully be excluded. LayagOFW does not control agency or principal decisions, interviews, contracts, government approvals, medical findings, visas, travel, workplace conditions, or off-platform conduct.
To the fullest extent permitted by law, LayagOFW is not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from use of the Platform. Nothing in these Terms excludes liability or rights that cannot be excluded or limited under applicable law.
19. Indemnity
To the extent permitted by law, an agency and any user acting commercially agrees to defend and indemnify LayagOFW against third-party claims, penalties, losses, and reasonable costs arising from that user’s unlawful recruitment activity, listings, Content, misuse of personal data, breach of these Terms, or infringement of another person’s rights. This does not apply to the extent a claim was caused by LayagOFW’s own unlawful conduct.
20. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without limiting mandatory protections that apply to a user. Before filing a claim, the parties should attempt in good faith to resolve the issue through the contact channel published by LayagOFW. Unresolved disputes may be brought before a court, tribunal, regulator, or government agency with lawful jurisdiction.
21. Changes, severability, and contact
LayagOFW may update these Terms to reflect service, safety, business, or legal changes. Material changes will be communicated through the Platform or another appropriate channel and will state their effective date. Continued use after the effective date constitutes acceptance where permitted by law.
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. The operating entity, registered address, legal notice channel, and effective date must be published here before production launch.
