Welcome to LayagOFW.com (“Platform”). These Terms of Use (“Terms”) govern your use of the services provided by LayagOFW.com, including but not limited to job postings, recruitment services, and advertisements. By using the Platform, you agree to comply with these Terms. If you do not agree to these Terms, you should not use this Platform.

These Terms apply to Employers, Candidates, Advertisers, and Recruiters, collectively referred to as “Users.”

  1. 1.Definitions

    • Employer: A company, organization, or individual who posts job listings and/or hires candidates for overseas work.
    • Candidate: An individual using the Platform to seek job opportunities overseas.
    • Advertriser: An entity or individual using the Platform to promote products, services, or content to other Users.
    • Recruiter: A licensed recruitment agency or entity facilitating the recruitment of Candidates for Employers.
  2. 2.Eligibility

    • 2.1. For Employers and Recruiters:

      Employers and Recruiters using the Platform must be duly licensed and authorized by relevant authorities, such as the Philippine Overseas Employment Administration (POEA), to engage in recruitment for overseas employment. You agree to comply with all applicable laws and regulations regarding employment and recruitment.

    • 2.2. For Candidates:

      Candidates must be at least 18 years old and meet the eligibility criteria for overseas employment under applicable laws and regulations. You agree to provide accurate and up-to-date personal information when registering and applying for jobs on the Platform.

    • 2.3. For Advertisers:

      Advertisers must comply with all applicable advertising laws, including truth in advertising standards. LayagOFW.com reserves the right to reject any advertisements that do not meet our guidelines or that are deemed inappropriate or unlawful.

  3. 3.Account Registration and Responsibilities

    • 3.1. Account Creation:

      All Users must create an account to access certain features of the Platform. You agree to provide accurate, current, and complete information during the registration process.

    • 3.2. Account Security:

      You are responsible for maintaining the confidentiality of your account credentials. LayagOFW.com is not liable for any unauthorized use of your account. If you suspect unauthorized use, you must notify us immediately.

  4. 4.Platform Services

    • 4.1. For Employers and Recruiters:

      Employers and Recruiters may post job listings, review applications, and communicate with Candidates via the Platform. All job postings must comply with POEA regulations and local employment laws in the country of destination. You agree to:

      • Not post misleading or fraudulent job offers.
      • Ensure that job offers are accurate and clearly outline the terms of employment.
      • Respect the rights and privacy of Candidates.
    • 4.2. For Candidates:

      Candidates can browse job listings, apply for jobs, and communicate with potential Employers and Recruiters. You agree to:

      • Provide accurate and truthful information about your qualifications, work experience, and identity.
      • Apply for jobs that match your qualifications and interest.
      • Understand that LayagOFW.com does not guarantee employment and that job opportunities are subject to Employers' hiring processes.
    • 4.3. For Advertisers:

      Advertisers can promote their products or services through designated spaces on the Platform. You agree to:

      • Submit truthful and lawful advertisements.
      • Refrain from advertising prohibited or restricted products or services.
      4.4. General Conduct:

      All Users agree not to engage in any unlawful activities on the Platform, including but not limited to fraud, harassment, hate speech, or any activity that violates another User's rights.

  5. 5.Prohibited Conduct

    You agree not to:

    • Not post misleading or fraudulent job offers.
    • Ensure that job offers are accurate and clearly outline the terms of employment.
    • Respect the rights and privacy of Candidates.
  6. 6.Fees and Payments

    • 6.1. For Employers and Recruiters:

      Certain features, such as premium job postings or candidate outreach services, may require payment. Any applicable fees will be outlined during the service purchase process. LayagOFW.com reserves the right to change fees at any time but will provide notice before such changes take effect.

    • 6.2. For Advertisers:

      Advertisers may be charged for placing ads on the Platform, subject to the advertising terms provided. All payments must be made in accordance with the agreed-upon terms.

    • 6.3. Refunds:

      Refund policies, if applicable, will be outlined on the Platform or in a separate agreement. LayagOFW.com reserves the right to determine refund eligibility on a case-by-case basis, following applicable laws and contractual terms.

  7. 7.Data Privacy and Use

    • 7.1. Data Collection:

      LayagOFW.com collects personal information necessary for job applications, recruitment processes, and advertisements. By using the Platform, you consent to the collection, storage, and processing of your data in accordance with our Privacy Policy.

    • 7.2. Data Use:

      Your data will only be used for the purposes outlined in these Terms or as required by law. We will not sell your personal information to third parties without your consent, except where required to facilitate employment or other services.

    • 7.3. Confidentiality:

      Employers and Recruiters agree to maintain the confidentiality of any personal information obtained through the Platform and to use such information solely for recruitment purposes.

  8. 8.Intellectual Property

    8.1. The content on the Platform, including but not limited to text, graphics, logos, and software, is the property of LayagOFW.com or its licensors. You may not use, reproduce, or distribute any content from the Platform without prior written consent from us.

    8.2. Employers, Candidates, Recruiters, and Advertisers retain all ownership rights to the content they submit to the Platform but grant LayagOFW.com a license to use, display, and distribute such content as necessary to operate the Platform.

  9. 9.Termination of Use

    • 9.1. For Employers, Candidates, and Advertisers:

      LayagOFW.com reserves the right to suspend or terminate your account at any time, with or without cause, for any violation of these Terms or applicable laws.

    • 9.2. For Recruiters:

      Recruiters must maintain valid licenses and approvals from relevant regulatory bodies. LayagOFW.com reserves the right to suspend or terminate any recruiter's access to the Platform if they are found in violation of regulatory requirements or these Terms.

    • 9.3. User-Initiated Termination:

      You may terminate your account at any time by contacting LayagOFW.com. Termination of your account does not affect your obligations under these Terms, including but not limited to any fees owed or indemnity provisions.

  10. 10.Limitation of Liability

    10.1. LayagOFW.com provides the Platform “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Platform will be error-free, uninterrupted, or secure.

    10.2. LayagOFW.com is not responsible for the actions of third-party Employers, Recruiters, or Advertisers. We are not liable for any employment decisions, advertisements, or the accuracy of job postings.

    10.3. In no event will LayagOFW.com be liable for any indirect, incidental, or consequential damages arising out of your use of the Platform.

  11. 11.Indemnification

    You agree to indemnify and hold harmless LayagOFW.com, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or any employment-related disputes.

  12. 12.Governing Law and Dispute Resolution

    12.1. These Terms shall be governed by the laws of the Republic of the Philippines.

    12.2. Any disputes arising from or in connection with these Terms shall be resolved through amicable settlement. If settlement is not reached, the dispute shall be submitted to the exclusive jurisdiction of the courts of Mandaluyong City, Philippines.

  13. 13.Amendments to the Terms

    LayagOFW.com reserves the right to update or amend these Terms at any time. Changes will be posted on the Platform, and your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
